Hajj in Social Perspective

The fact that Hajj has been granted the status of being the third pillar of the secondary principles (Foroudeen) Islam is itself an indication of its importance in religion (Deen). Indeed, such stress has been laid on the performance of Hajj that no person upon whom Hajj has become compulsory should ever delay in fulfilling this obligation. The Prophet (SAW) is reported to have said: “The one who was not prevented from Hajj by a definite need, or a tyrant ruler, or a severe illness and he passed away without having performed the Hajj, then he may pass away if he wishes as a Jew or, if he wishes, as a Christian” (Daaremi). Allahu Akbar! What a stern warning!

All Muslim brothers and sisters must bear in mind that one of the important elements of the philosophy of Hajj is creation of mutual understanding and consolidation of brotherhood among the Muslims. What follows is a summary of a number of discussions held by me and three other seminarians, where arguments of numerous jurists on the legal age of maturity (bulugh) for girls were investigated. Even though we find a classical scholar considering menstruation as the criterion for the obligation of fasting in the month of Ramadan, the popular opinion amongst Shiʿi Imami jurists has been that the age of bulugh for girls for all religious duties including fasting is nine lunar years.

This year (1960) the governments of Pakistan and Tunisia have decided to rely upon the opinion of astronomers for the confirmation of the new moon with a view of putting an end to confusion 1 and the general inconvenience resulting from not knowing in advance the day of `Id, which at times comes as a surprise, and at other times is delayed despite all the preparations.
