In elucidating the Islamic political theory, we have made some discussions during the previous sessions and pointed out that the subject can be approached in two ways. One approach is argumentative [jadali], in which the fact that the addressee is a Muslim who adheres to Islam and Shi‘ism or believes in other ideological and moral fundamentals is disregarded; basic principles and foundations agreed upon by the two sides are taken into account as the principles and basis of discussion.

As explained in the last session, the above theory is based on an array of statutory principles. The first principle is the exigency of law for society while the second principle is that the law must be divine. After these two stages comes the issue of the implementer of law. Proving this theory to Muslims who accept those principles and believe in the Islamic fundamentals is not difficult. However, in dealing with those who reject those principles and the Islamic fundamentals, or those who wish to delve into the issue in order to be able to reply to the opponents, each of the principles must be explained in more detail.

Usurpation means that a person unjustly seizes the property or right of another person. This is one of the major sins and one who commits it will be subjected to severe chastisement on the Day of Judgement. It has been reported from the Holy Prophet (s.a.w.a.) "that whoever usurps one span of another's land, seven layers of that land will be put round his neck like a yoke on the Day of Judgement".

We have come to know that 'Ilmul Usul studies the common elements in the process of deduction to derive laws of the Shari'ah, hence, it is necessary at the very outset to formulate a general concept of a law of the Shari'ah. 'Ilmul Usul pursues its derivation by defining the common elements in the process of deduction (Istinba-t)"A law of the Shari'ah is the legislation originating from Allah Almighty to regulate the life of man.

In the previous discussion, "The Principle of Ijtihad in Islam", two trends in Islamic thought were referred to. One of them related to the subject of the justifiability or unjustifiability of the use of qiyas and ijtihad bi al-ra'y, a practice that acquired prevalence among different schools of fiqh. The other was regarding the controversy about Divine justice and reason as the criterion of moral and legal judgements (al-husn wal-qubh al-'aqliyyan) among the mutakallimun. These controversies actually revolved around the central issue of the role or the "rights" of reason.

Sujud is the adornment of prayer. So, perform it properly. Imam Sadiq (A.S) says: “Whenever you perform prayer, perform the ruku and sujud well as God will give seventy times the reward or even more.”[1]
